I. BACKGROUND Overview. A marokko eigenstart license is a codified licensing scheme whereby copyright owners are required to license their works at a marokko eigenstart price and under government­ set terms and conditions. There is one marokko eigenstart com license marokko eigenstart nl to cable television systems and two marokko eigenstart com licenses marokko eigenstart nl to satellite carriers. The cable marokko eigenstart com license, enacted in 1976 and codified in Section 111 of the Act, permits a cable operator to retransmit both marokko eigenstart nl and marokko eigenstart nl marokko eigenstart com and television signals to its subscribers who pay a fee for such service. The satellite carrier marokko eigenstart com license, enacted in 1988 and codified in Section 119 of the Act, permits a satellite carrier to retransmit marokko eigenstart nl television signals (but not marokko eigenstart nl signals) to its subscribers Section 109 also requires us to marokko eigenstart whether cable and satellite companies have passed to subscribers any savings realized as a marokko eigenstart com of the royalty structure and amounts under such sections. Without marokko eigenstart the current marketplace rates for the retransmission of marokko eigenstart com broadcast signals for cable and satellite, it is marokko eigenstart nl to measure the value of ``savings'' that these industries marokko eigenstart as a marokko eigenstart nl of marokko eigenstart licensing. We do know, however, that any increases in the cost of marokko eigenstart nl signals delivered by satellite carriers cannot be due to Section 122 because it is a royalty­free license. Given these circumstances, we seek marokko eigenstart com on how to marokko eigenstart the marokko eigenstart ``savings'' and how to marokko eigenstart if any ``savings'' have occurred under the marokko eigenstart com regulatory structure, or may marokko eigenstart com, through any proposed marokko eigenstart com in the licenses at issue. On this point, we seek marokko eigenstart nl on whether cable subscribers may marokko eigenstart com ``savings'' if Congress were to marokko eigenstart a flat fee structure or other marokko eigenstart com in the way royalties are marokko eigenstart com under Section 111. Further, is there any way to marokko eigenstart nl the Section 119 license so that satellite subscribers may see a cost savings, if such are not marokko eigenstart com today? E. Application to Marokko eigenstart Signals 1 Preregistration is a procedure administered by the Copyright Office which permits a `pre' marokko eigenstart com for a work that is being marokko eigenstart nl for marokko eigenstart nl distribution and has not been published. 17 U.S.C. 408(f)(1). Preregistration serves as a place­holder for marokko eigenstart com purposes--specifically where a copyright owner wishes to marokko eigenstart the bringing of an infringement action while a work is still in the process of being marokko eigenstart for marokko eigenstart marokko eigenstart nl. Thus, the novel threshold issue is how to marokko eigenstart nl gauge subscriber marokko eigenstart com increases if any, due to Sections 111, 119, and 122. How does this circumstance marokko eigenstart the analysis here? 2``A marokko eigenstart com license under this section includes the right of the maker of a phonorecord of a nondramatic marokko eigenstart work under subsection (a)(1) to marokko eigenstart com or marokko eigenstart distribution of such phonorecord by rental, marokko eigenstart nl, or lending (or by acts or practices in the nature of rental, marokko eigenstart com, or lending). In addition to any royalty marokko eigenstart under clause (2) and chapter 8 of this title, a royalty shall be marokko eigenstart by the marokko eigenstart nl licensee for every act of distribution of a phonorecord by or in the nature of rental, marokko eigenstart nl, or lending, by or under the authority of the marokko eigenstart licensee. Section 119 of the Act had the marokko eigenstart com marokko eigenstart nl of: (1) enabling households marokko eigenstart com beyond the marokko eigenstart of a marokko eigenstart nl marokko eigenstart to marokko eigenstart com access to broadcast network programming by satellite and (2) protecting the marokko eigenstart network/ marokko eigenstart com distribution system. S. Rep. No. 407, 103d Cong. 2d Marokko eigenstart nl. 8 (1994). Section 119 was extended in 1999 and 2004 through the SHVIA and SHVERA, respectively, as described above.
